1. Acceptance of Terms

By accessing and using the Sim Time website and facility, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services or enter the facility.

2. Facility Description

Sim Time is an unmanned simulator and entertainment facility located in Williamstown, Kentucky. Customers reserve time slots online and receive time-limited access codes via SMS and email to enter during their booking window.

3. Bookings and Reservations

• All bookings must be paid in advance through our secure online payment system
• Access to the facility is limited strictly to your reserved time slot
• Only registered guests named in the booking are permitted entry
• Unauthorized guests or early/late access may result in additional fees or booking cancellation
• Bookings are confirmed upon payment and receipt of confirmation email

4. Access Codes and Entry

• Upon confirmation, you will receive a unique access code via SMS and email
• Access codes are active only during your reserved time slot
• Do not share your access code with unauthorized individuals
• Unauthorized access or code sharing may result in immediate termination of your booking, additional fees, and potential legal action
• Entry and exit times are logged electronically for security purposes

5. Facility Rules and Guest Responsibilities

All guests must:

• Clean up after themselves and dispose of all trash in designated receptacles
• Sanitize equipment after use with provided cleaning supplies
• Treat all equipment, furniture, and the space with respect
• Use equipment safely and as intended
• Follow all posted rules and safety guidelines
• Exit the facility within 10 minutes of their booking end time
• Not move, unplug, or adjust equipment or furnishings
• Keep food and drinks away from equipment and electronics
• Clean up any spills immediately

6. Security and Monitoring

The facility is monitored by video surveillance cameras at all times for safety, security, and damage prevention purposes.

• Security cameras record continuously inside the facility
• Entry and exit logs track all access code usage
• Video footage and access logs may be reviewed to investigate damage, rule violations, unauthorized access, or safety incidents
• By entering the facility, you consent to being recorded

7. Damage Liability and Fees

Card-on-File Damage Protection:

• Standard Sim Time bookings do not include an upfront damage deposit. The payment method used for the reservation is saved securely for the limited purposes described in these terms.
• By booking, you authorize Sim Time to charge the saved payment method for documented damage, excessive cleaning, theft, or rule violations caused by you or your guests, up to a maximum of $500 total.
• Examples include equipment damage from misuse or negligence, excessive mess or spills, moving or tampering with equipment, food or liquid damage to electronics, theft, vandalism, or conditions requiring extraordinary cleaning, repair, or facility downtime.
• Advance notice: Before a damage charge is processed, Sim Time will email the booking customer with the proposed amount and reason at least 24 hours in advance so the customer has an opportunity to contact us about the claim.
• Damage claims should be supported by available documentation, such as inspection records, photographs, video timestamps, or repair/cleaning costs, and will be initiated within 7 days of the booking end time.
• Certain partner bookings may use a separately disclosed refundable damage deposit. For example, the NeatSuites booking flow currently discloses and collects a $25 refundable deposit under the terms shown during that checkout.

8. Liability Waiver Requirement

• All guests must complete and sign a liability waiver prior to entering the facility
• Entry into the facility without a signed waiver is strictly prohibited
• By entering the facility, guests acknowledge and accept all posted rules, safety terms, and assumption of risk
• Parents or legal guardians must sign waivers on behalf of minors
• Failure to complete required waivers may result in booking termination and deposit forfeiture

9. Age Requirements

• All bookings must be made by an adult 18 years of age or older
• At least one adult must be present during the entire booking period
• Minors must be supervised by an adult at all times

10. Limitation of Liability

Sim Time is not responsible for:

• Injuries resulting from misuse of equipment or failure to follow safety guidelines
• Lost, stolen, or damaged personal items
• Technical interruptions or equipment malfunctions
• Force majeure events including natural disasters, power outages, or events beyond our control
• Any indirect, incidental, special, or consequential damages

To the maximum extent permitted by law, Sim Time's total liability shall not exceed the amount paid for your booking.

11. Right to Refuse Service

We reserve the right to revoke access, terminate bookings, or refuse future service without refund for:

• Rule violations
• Unsafe behavior
• Disrespectful treatment of the facility or equipment
• Unauthorized access attempts
• Any conduct deemed harmful to the facility, equipment, or other guests

12. Cancellations and Refunds

• Cancellations made 24 hours or more before your booking receive a full refund
• Cancellations within 24 hours of your booking are non-refundable
• No refunds will be provided for early departure or unused reservation time
• Refunds may be issued for verified technical failures or facility closures
• All refund decisions are at Sim Time's sole discretion

13. SMS and Email Communications

• By booking, you consent to receive SMS and email communications related to your booking, including confirmations, access codes, reminders, and important facility updates
• These messages are essential to your use of our facility and provide critical information about your reservation
• Standard message and data rates may apply to SMS messages
• We will only contact you with information relevant to your booking and facility operations
• This agreement isn't a condition of any purchase
• No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

14. Intellectual Property

All content on the Sim Time website, including text, graphics, logos, and software, is the property of Sim Time and protected by copyright and trademark laws. Unauthorized use is prohibited.

15. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy for information about how we collect, use, and protect your personal information.

16. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved exclusively in the courts of Grant County, Kentucky.

18. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
